Fan Appeals Ruling Over WWE WrestleMania 38 Incident Lawsuit
A lawsuit against WWE rumbles on

WWE continue to be involved in legal proceedings over a lawsuit that appeared to have been settled.
A fan named Marvin Jackson filed a lawsuit against WWE on January 12 in which he claimed he lost hearing in his left ear while he was in attendance at WrestleMania 38 in 2022. Jackson alleged he suffered the hearing loss following a blast of pyrotechnics. The fan requested a jury trial and was seeking damages in excess of $1 million.
The lawsuit was dismissed with prejudice last week and the case was moved to arbitration.
In an update, Jackson filed a notice of appeal on May 11 with the United States District Court for the Northern District of Texas, Forth Worth Division. The court filing did not note what grounds Jackson's appeal was based on.
WWE were able to get the case sent to arbitration after arguing to the court that before fans purchase WrestleMania tickets, they have to tick several boxes and agree to the terms and conditions of the ticket purchase. Part of the terms and conditions is agreeing to enter arbitration over any legal issues.
